Recording Phone Calls in the UK: A Practical Legal and Privacy Checklist

Recording a phone call in the UK can engage several different rules at once. The answer depends on who is recording, whether it is personal or organisational, why it is needed, what information is discussed, how participants are informed and what happens to the audio afterwards.

Ofcom advises that a range of laws may apply to recording calls and that legal advice may be appropriate. Organisations should also check current ICO guidance, sector requirements, employment rules and their own call-recording policy. This article provides an operational checklist, not legal advice.

Classify the call before choosing a tool

Write a call-recording specification

Before deployment, document:

  1. the precise purpose
  2. the category of calls included and excluded
  3. the lawful and policy basis assessed by the organisation
  4. the notice or agreement process
  5. the approved device, app and account
  6. who can access audio and transcripts
  7. how accuracy is checked
  8. the final system of record
  9. retention and deletion
  10. the route for access requests, objections and complaints

A generic “calls may be recorded” message does not by itself resolve every issue. The actual use and handling must match the stated purpose.

Use clear notice

Where the organisation’s process requires notice or agreement, explain it before substantive discussion:

“I would like to record this call to create an accurate service note. The recording and transcript will be handled under our privacy and retention process. Are you happy to continue on that basis?”

Record the answer. When the other person declines, use the approved non-recording route rather than hiding a local recording.

Pause for excluded information

Do not capture passwords, full payment-card details, security answers or unrelated private discussion. Use the organisation’s secure systems for identity, payment and sensitive-document exchange. Where the call moves into a category outside the approved purpose, stop and reassess.

Separate the call from the official record

A customer promise, supplier commitment, complaint outcome or professional attendance note should enter the authorised system after verification. The raw transcript may mishear names, dates, account references, prices and conditions.

Keep clear status labels:

  • reported by caller
  • verified fact
  • proposal
  • agreed action
  • formal commitment
  • open question

Control staff monitoring

When recordings are used to monitor or assess workers, obtain appropriate HR, privacy and legal review. Explain the purpose, scope, access, decision process and retention. Avoid collecting more calls or keeping them longer than the documented need.

Check the complete technology route

Confirm whether audio is stored on the phone, recorder, app account, cloud service, exported folder or CRM. Review supplier terms, security, subprocessors, international data movement and deletion controls. A locally captured call can still create cloud copies during transcription.
